Abstract: Trademarks and trade names are important tools to enterprises reach customers. Although the function of the trademarks and trade names are different but for Small and Medium Enterprises, they use these two concepts together with similar meaning. With the different principle of establishing rights, namely the rights to the trademark shall be established on the basis of subscription rights also for the trade name shall be established on the basis of use, the scope of the rights of the two objects are different, but in fact they have the same usage lead to conflict between the two objects, making it difficult for the enforcement of the rights of both the owners and the state agency competent to execute. Registered trademarks of the companies and the relevant data is stored centrally on a clue that National Office of Intellectual Property of Vietnam. As for the trade names registered and licensed, the data stored in the Department of Planning and Investment of provincial/city and in the database of the national enterprise registration. Therefore, to manage the trademarks and trade names should develop policies that link scientific information and technology between the Ministry of Science and Technology with the Ministry of Planning and Investment, to avoid trademarks and trade names duplication or similar together.
